Job Summary (Primary function)
The Global Data Privacy Officer leads Incyte's global privacy program, working with Incyte legal counsel, data protection officers, all business units, and IT Cybersecurity to ensure that Incyte is in compliance with all global, regional, country and local privacy and data protection laws and regulations. The Global Data Privacy Officer drives the development, implementation, and ongoing enhancement all privacy and data protection processes and procedures in an effective and efficient manner and provides guidance regarding privacy implications of various business opportunities and plans.
Essential Functions of the Job (Key responsibilities)
Continually develop and enhance Incyte's global privacy program; execute against annual Global Privacy Plan.
Manage the privacy team who are involved in the day-to-day operationalization of the privacy program.
Collaborate with partners in senior leadership, compliance and all business units to address risks, recommend solutions, and ensure compliance with applicable privacy and data protection laws/regulations.
Oversee all records of processing/privacy assessments, data protection impact assessments, and transfer impact assessments to ensure not only the compliant and responsible management of personal data but also proper evaluation of legal basis(es), transfer mechanisms, notice/consent, etc.
Create and maintain internal corporate policies and SOPs that are consistent with applicable privacy and data protection laws.
Investigate and address all data subject inquiries, access requests, and complaints regarding Incyte's privacy practices in collaboration all internal and external groups as necessary.
Remain current on and keep management up-to-date regarding any new and/or evolving privacy and data protection laws, trends, and best practices.
Train employees on company privacy policies, data handling practices and procedures, and legal obligations.
Lead Incyte's response to data incidents that involve personal data; coordinate with Cybersecurity, senior leadership and all applicable business units.
Assist Incyte legal counsel with data processing agreements and all other contracts' privacy provisions.
Manage the privacy audit program to monitor compliance with privacy processes and procedures.
Work with IT and management to assess vendors', collaborators', and other third parties' technical and organizational security measures to ensure personal data security.
Prepare and present reports on privacy risks and metrics to key stakeholders and senior management.
Cooperate with and handle communications with data protection regulators.
Qualifications (Minimal acceptable level of education, work experience, and competency)
Law degree and/or Master's degree in public health or healthcare compliance.
Education or certification in Privacy (ie: CIPP) preferred.
10+ years of experience in the pharmaceutical/medical device industries.
Experience in privacy and/or managing a privacy program within the pharmaceutical/medical device industries.
Understanding of relevant legal, regulatory, compliance, and business environment relevant to the pharmaceutical industry.
Technically-minded with the ability to analyze privacy and data protection issues that may arise across all business units.
Ability to work independently and make strategic decisions as they relate to privacy and Incyte's business operations.
Ability to manage multiple priorities with strong organizational, management and decision-making skills.
Excellent communication, presentation, and writing skills including the ability to communicate effectively through presentations and individual discussions with all levels of the organization.
Ability to influence key decision makers.
Able to proactively identify issues and develop business-friendly solutions.
Results-oriented, team player, and able to work well with all levels of the organization.
Fluent in English with ability to speak other languages preferred.
