6 Temporary Fulltime Nursery Worker. Forest View Nursery Inc, Clayton, DE. 2/20/2020 – 12/18/2020, Job duties: Loading and unloading plants to/from trucks, ground keeping of facility, operate farm equipment, weeding pruning, moving plants, dig plants for sale, application of fertilizers, grade and sort products according to factors such as color, spaces, length, width, appearances, feel for quality to ensure correct processing and usage. Discard interior or defective products and or foreign matter and place acceptable products in containers for further processing, place product in containers according to grade and mark grades on containers. *Measure, weigh and count products. *Examine and inspect containers, materials to ensure specifications are met, clean and maintain work area & materials other related activities. *Perform extensive repetitious walk, stand, stoop, bend, reaching and may need to load/unload up to 60lbs. *Tools, equipment and supplies provided at no cost to worker, for work day only, stored and maintained at farm. *Manual, motorized tool usage all day. *Work outdoors, exposed to all weather conditions, hot, cold and possible rain, hours may fluctuate (+/-); possible downtimes and/or extended hours. *Dependable: fulfill obligations. Attention to details to complete work tasks. Self control. maintain composure, keep emotions in check, control anger, avoid aggressive behavior, display a good nature. *Proper work attire is required- shirts w/sleeves, long pants, no shorts, hard sole shoes, no tennis shoes, Drugs & alcohol free work zone. *Required to show proof legal authorization to work in United States. 6 month of handling/nursery experience.
*Housing provided at no cost to workers and those workers in corresponding employment who are unable to return to their place of residence the same day. $13.34 /hr, Schedule workweek is 40 hrs/wk (may exceed hrs depending on field/crops conditions); Required to work day, evenings &/or night shifts.

Transportation & subsistence expenses ($12.46 daily w/o receipts, and $51.00 daily with receipts) to the worksites will be paid by the employer upon completion of 50% of the work contract, or earlier; Daily meals will be provided at a rate of at least $12.46 per day of travel or the current minimum subsistence amount published in the Federal Register, to a maximum of $51.00 per day or the current maximum amount published in the Federal Register to workers with acceptable receipts.
Transportation between housing and worksite will be provided daily at no cost to the worker.
A single workweek will be used to compute wages due. The payroll period is weekly. Workers are paid on Friday by check.
Employer will offer 40 hours per week.
The employer will make all deductions from worker’s paycheck required by law.
The workers are covered by Unemployment Insurance and Workers Compensation.
The employer agrees that no extension of employment beyond the period of employment shown on the job order will relieve the employer from paying the wages already earned, or specified in the job order as a term of employment, providing transportation or paying transportation expenses to the workers home. The employer assures that all working conditions comply with applicable federal and state minimum wage, child labor, social security, health and safety, farm labor contractor registration and other employment related laws.
Employer will comply with first week wage guarantee.
Job offer states the charge, if any, to the worker for meals provided by the employer.
Return transportation and subsistence is paid upon completion of 100% of the work contract.
The employer will furnish cooking facilities, utilities and utensils for workers to prepare their own meals.
Employer will provide transportation to grocery or laundry mat.
Employer will furnish the worker on or before each payday writing hours and earnings statements.
Workers who voluntarily abandon employment or are terminated for cause, and where the employer provides timely notification to the NPC and DHS, will relieve the employer for subsequent transportation and subsistence costs and the 3/4th guarantee.
The employer may terminate the work contract where services are no longer required for reasons beyond the employer’s control due to fire, weather, or other Act of God. The 3/4th guarantee will be provided between the start and termination dates, make efforts to transfer the worker to other comparable work acceptable to the worker, and, if transfer is not viable, provide outbound transportation and subsistence.
The employer is to provide workers with a copy of the work contract, including any approved modifications, on the day work commences or as soon as practically possible.
